Position Title: Court of Protection SolicitorLocation: London, Brighton, Cornwall, Bristol. Crawley, Somerset, Nottingham, Liverpool and Cambridge (Will Consider Remote)Salary: £35000 +Reference: BH-36884Work Type: Full-time – 37.5 hours per week; 9.30am-5.30pm Monday–Friday (Alternative working arrangements including part-time hours will be considered)About The Firm:My client is a leading law firm specialising in various areas of legal practice, including Court of Protection and community care. They are known for their commitment to providing high-quality legal services and their supportive work environment.Position Overview:My client is seeking a Court of Protection Solicitor with experience and/or knowledge in community care. The ideal candidate will have a solid background in Court of Protection casework and be able to work both independently and as part of a team. Experience in creating and implementing compliant processes and procedures is essential.Key Responsibilities:
  • Meet the LAA supervisor requirements for the Community Care legal aid contract, including specific requirements for cases under the Mental Capacity Act 2005.
  • Handle a range of Court of Protection casework, including 21A Deprivation of Liberty challenges and s.16 proceedings.
  • Advise and represent ‘P’ via a litigation friend (including the Official Solicitor) or family members within proceedings.
  • Work independently and as part of a team, creating and implementing team-wide processes, procedures, and precedents.
  • Self-supervise and maintain high standards of legal practice.
  • Achieve or maintain Accredited Legal Representative status or undertake required training and assessment.
Requirements:
  • Experience and knowledge of Court of Protection casework and community care law.
  • Ability to advise and represent clients in complex legal proceedings.
  • Experience in developing and implementing legal processes and procedures.
  • Capability to work independently and as part of a team.
  • Accredited Legal Representative status or willingness to complete necessary training.
Desirable:
  • Knowledge of wider community care law, including the Care Act, housing legislation, and legislation relevant to families and children.
  • Experience in supervising team members.
  • Ability to write and deliver training on mental capacity issues.
  • Experience in handling mental capacity issues across various areas of law, including education, housing, immigration, and public law.
